The figures are averages, not bids

Every price here is a head-weighted average of sales the USDA Agricultural Marketing Service published, across many auctions in a completed week. It describes what a lot of cattle brought. It is not a quote, an offer, a bid, or a forecast, and it is not what your cattle will bring. Your cattle will bring what the ring says on the day, and that depends on quality, fill, condition, weather, who turned up to buy and a dozen other things no average can see.

We take real care with the arithmetic and we check it against USDA's own published summaries. We still do not warrant that any figure is accurate, complete or current. USDA reports late, revises, and sometimes does not report at all; a market can drop out of a week without warning. Where a class is too thin to mean anything we say so rather than printing a number, and where we show a figure we tell you what basis it is on.

It is not advice

Nothing on this site is financial, investment, tax, legal, veterinary or business advice, and no part of it is a recommendation to buy, sell, hold or haul anything. The Cattle Square, the calf calculator and the explainers are educational tools: they do arithmetic on numbers you give them and on public averages. The judgement stays yours.

Check with your sale barn, your buyer, your banker or your accountant before you act on anything you read here. They know your cattle and your situation. We do not.

What we are not liable for

The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

To the fullest extent the law allows, Bluestem Digital LLC and anyone working with it are not liable for any loss or damage arising out of your use of, or reliance on, this site — including lost profits, lost sales, a trade that went against you, or any indirect, incidental, special, consequential or punitive damages — even if we were told such losses were possible. Where liability cannot be excluded, it is limited to one hundred US dollars.

Some states do not allow certain exclusions, so part of this may not apply to you.

Fair use of the site

The tools are free and open. Use them for your own operation, share the pages, quote the figures.
Do not scrape the site at a rate that interferes with it, resell the data as your own product, or present our figures as though they were your own market report.
The underlying USDA data is public and belongs to nobody. Our writing, design, code and the way the figures are put together are ours.
Do not use the site to break the law or to interfere with anyone else's use of it.

Links out to YouTube, Facebook, Bluestem Digital, USDA or anywhere else are for convenience. We do not control those sites and are not responsible for them.

Changes, and the law that applies

The site changes constantly and these terms may change with it; the date below says when they last did. These terms are governed by the laws of the State of Oklahoma, without regard to conflict of law rules, and any dispute belongs in the state or federal courts sitting in Oklahoma.
